This case comes before the court on defendant’s exceptions to the recommended decision (including an opinion, findings of fact, and conclusions of law) filed by Trial Judge Mastín G. White. After hearing oral *400argument and considering the government’s exceptions and the briefs of the parties, as well as the record as a whole, the court hereby adopts the trial judge’s findings and opinion, as supplemented by the following, as the basis for its judgment in the case.1
