Director of Revenue (“Director”) appeals from the trial court’s judgment reinstating the driving privileges of Richard Mark Warren (“Petitioner”) after judicial review of revocation based on his refusal to submit to a chemical test pursuant to section 577.041, RSMo Cum.Supp.2010. Director contends that the trial court misapplied the legal standard for reasonable *338grounds to believe Petitioner was driving a motor vehicle while in an intoxicated condition and that the revocation of Petitioner’s driving privileges should be reinstated.
