This was an action to quiet plaintiff's title in and to a described 480 acres of land in Ellis county owned by Grace E. McConchie at the time of her death on August 6, 1931, and for the construction of her will, the pertinent portions of which read:

“I, Grace E. McConchie, being of sound mind, do hereby bequeath all my earthly possessions to my four children, Guy E. Lewis, Jessie E. Lesher, James C. McConchie and William McConchie. I wish said property or real estate to be held in common as long as my children live. Either of them dieing,…
