BACKGROUND
Appellant Marianas Public Land Trust (MPLT) filed a complaint in the Commonwealth Trial Court on October 1, 1984, seeking declaratory and injunctive relief against the Commonwealth of the Northern Mariana Islands (CNMI). *873Specifically, appellant sought to have declared unconstitutional a transfer of funds from the Marianas Public Land Corporation (MPLC) to the CNMI General Fund. These funds were received from the United States government as the remaining payment under the Tinian Lease Agreement.
