This suit was instituted by plaintiffs, as tax payers of Holt county, on behalf of themselves and other tax payers of said county, to enjoin and restrain the payment of certain warrants issued by the county court of said county to Moses Bennett. It is substantially averred in the petition that in the year 1881 the county court entered into an original, and two supplementary contracts with Moses Bennett, in which it was sought to bind the county to pay said Bennett the sum of <$9,600, for making three additions to and remodeling the court house of said county, in the town of Oregon ; that said…
