McCoon v. State
Court of Appeals of Georgia
1Opinion of the Court
BLACKBURN, Presiding Judge.
Following his guilty plea to three felony counts (armed robbery,1 burglary,2 and aggravated assault3), Jonathan McCoon appeals the trial court’s denial of his motion for an out-of-time appeal. He argues that his counsel’s failure to appeal the armed robbery conviction constituted ineffective assistance and that the record failed to show that he entered into the plea freely and voluntarily. Because the record supports neither argument, we hold that the trial court did not abuse its discretion in denying his motion for an out-of-time appeal.
