*56 ¶ 1 Following a bench trial, defendant, Marc A. Pepitone, was found guilty of being a child sex offender in a public park pursuant to section 11-9.4-1 of the Criminal Code of 2012 (Code) ( 720 ILCS 5/11-9.4-1 (West 2014) ) and was sentenced to 202 days in the Du Page County jail. Defendant appeals, contending that section 11-9.4-1 is unconstitutional as applied to him because it violates the ex post facto provisions of both the United States and Illinois Constitutions.
