In the 1980’s respondent City of Glens Falls in Warren County, through its Urban Renewal Agency, acquired and improved certain real property to induce CB Sports to locate within the City. The project, which cost about $1.6 million, was funded by the issuance of Urban Renewal Agency bonds, payment of which was guaranteed by the City. The property was transferred to a subsidiary of the State Urban Development Corporation and leased to CB Sports, which in 1986 entered into an agreement to make annual "payments in lieu of taxes” (hereinafter the PILOT agreement)…
