In an action to foreclose a mortgage, order of the County Court, Nassau County, entered on November 19, 1940, denying appellant’s motion to vacate a previous order entered on September 11, 1940, which granted respondents’ motion for leave to enter a deficiency judgment, reversed on the law, with ten dollars costs and disbursements, and the motion granted, with ten dollars costs.
