Appellant, as trustee in a deed of trust executed by Will Sykes in favor of Sledge and Caffey, brought an action of replevin in the court of a justice of the peace of Montgomery county against appellees for two bales of cotton and some corn, claiming that the cotton and corn were subject to the deed of trust for the payment of the indebtedness thereby secured.
