Richard Pontremoli was fired in October, 1996, by Spaulding Rehabilitation Hospital (hospital), where he had worked as a cook since 1989. Pontremoli’s complaint alleges that the hospital terminated him in retaliation for his refusal to falsely implicate a co-worker in a purported workplace theft, and thus violated G. L. c. 151B, § 4. The hospital’s motion to dismiss the complaint, for failing to allege protected activity that was linked to, or that occurred prior to, his termination, *623was allowed by a judge of the Superior Court.
