In this ease the town ordinance appears not to have been observed, in taking up and in selling the horse in controversy. The ordinance provided, that if cattle, horses, mules, asses, hogs, sheep or goats, shall be found going at large, in the town, at any time, except between the first and fifteenth days of February in each year, the poundmaster shall take them up and impound them.
