The plaintiff, administratrix of the estate of Michael Marino, brings this action of tort to recover for Marino’s death under the Jones Act (46 U.S.C. § 688 [1952]), or alternatively under the Massachusetts death statute (Gr. L. e. 229, § 20). The defendants are the own ers and operators of four fishing vessels out of Gloucester (Hazel B, Pilgrim, Bosie & Graeie, and Bose Marie).

The case was tried to a jury, and at the close of the evidence verdicts were directed for all of the defendants on the Jones Act counts, subject to the plaintiff’s exceptions. Motions for directed verdicts on the…
