LATTIMORE, Justice.

The state highway commission, building a highway from. the Red river, which highway was to pass through the city of Gaines-ville, an incorporated city of more than 5,000 inhabitants, requested said city, appellant, to procure for the state of Texas a certain tract of land within the city limits of said city as a part of said highway. The appellant, by a trade, procured said land from the owner, and same was deeded to the state of Texas in February, 1931.
