Gregory Wadlow (“Wadlow”) appeals the Circuit Court of Cole County’s (“circuit court”) denial of his Rule 74.06 motion. We reverse the circuit court’s judgment.

Factual and Procedural Background

Wadlow is currently serving a thirty-year sentence for second-degree murder. His scheduled release date is October 13, 2037. On September 16, 2008, the Missouri Attorney General filed a petition against Wadlow seeking reimbursement for the costs of his incarceration as authorized by the Missouri Incarceration Reimbursement Act, §§ 217.825-217.841, RSMo *5922000 (“MIRA”).
