Clayton George Smith (“Smith”) appeals the rulings of the Circuit Court of Stafford County (the “trial court”) 1) denying his motion to suppress the statements given during an encounter with a detective and 2) denying his motion to withdraw his guilty plea to driving while his license was suspended. Specifically, Smith argues that his statements to the detective were the unconstitutional product of a custodial interrogation where no Miranda warning was given as required by Miranda v.
