This is an appeal from a decree of the circuit court of Multnomah county that certain property of the decedent, Martin Pekarek, escheat to the state of Oregon. The decree is based upon findings that Pekarek was a resident and domiciliary of Czechoslovakia at the time of his death; that at that time he had a savings account of approximately $7,600 in the First National Bank of Portland; that the legatees of his will were residents and nationals of the Eepublic of Czechoslovakia; that these legatees failed to establish the right to take under OES 111.070; and that there were no other heirs,…
