The principal questions in this case .arise upon the pleadings.
The original action in the court of common pleas of Butler county was brought by plaintiff in error against the defendant in error to recover damages for the breach of a parol contract. The plaintiff's case was stated in its .amended petition, which will be understood from the following extracts :
