This is an appeal from an order of the district court of Logan county denying motion to vacate a forfeiture of an appeal bond in a criminal proceeding.

On May 8, 1946, the principal on the bond, Buster Lee Gibson, in a case then pending in the district court of Logan county, was, by the verdict of a jury, found guilty of the crime of burglary in the second degree and his punishment was fixed at imprisonment in the State Penitentiary for a term of five years.
