Appeal by defendant from an order of the municipal court of St. Paul, Finehout, J., affirming a judgment of a justice of the peace.

According to the record in this case the summons in justice court, returnable on December 4, 1905, at nine o’clock a. m., was personally served. Three days before the date of the return the defendant’s attorney appeared and answered orally and asked for one week’s continuance. This was denied because the case had not been at that time ■called. On the return day the case was called, there was no appearance on the part of the defendant. Defendant was defaulted.
