Appellant sued appellee for damages for personal injuries, alleging sajnfe resulted from a defective crossing maintained by appellee at a point in Hunt county where its line of railway crosses a public county road, or, if not a public county road, One, nevertheless, which had for many years been used by the public as a highway, and over and upon which appellee had constructed and maintained a crossing for the use of the public.
