City Bank v. Hocke

Appeal by the defendant, West Side Laundry Company, from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 12th day of April, 1915, directing that a writ of assistance issue to the sheriff to eject and remove the appellant from certain premises.

Clarke, J.:
Julius GL Hocke was the owner of premises 509-513 West Fiftieth street. He was also the president of the West Side Laundry Company. This company had been openly occupying a portion of this building for some years, as a laundry, exhibitng its sign thereon, “West Side Laundry Co.” On the 1st of May, 1913, Hocke made a written lease of the portion of the premises occupied by the laundry to John O’Mara for ten years from said date, with the privilege of renewal for a further term of ten years, at a yearly rental of $6,194.
