Appeal by the defendant, Alvin D. Wallace, from an interlocutory judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Onondaga on the 3d day of July, J899, upon the decision of the court rendered after a trial at the Jefferson Special Term overruling his demurrer to the plaintiff’s complaint, and also from an order entered in said clerk’s office on the 3d day of July, 1899, upon which the judgment was entered.

The plaintiff seeks to recover damages for her seduction by the defendant. The complaint alleges that the plaintiff became an orphan at the age of fourteen years; that she was related to defendant’s wife; that defendant was shortly thereafter appointed general guardian of the person and property of the plaintiff by the surro*102gate of Cortland county; that he filed a bond, took his oath of office and entered upon the trust; that within a year thereafter he took plaintiff to reside at his home, and thereupon, in violation of his trust and of the duties and obligations he, as such…
