JANVIER, Judge.

This is a suit by the designated beneficiary on two industrial life insurance policies each in the sum of $750. The decedent on whose life the policies were issued was Angle L. Holland, forty-two years of age. The beneficiary was in no way related to the insured.

The defense of the insurers as made out by the pleadings prior to the filing in this Court of an exception of no right or cause of action was that, although at the time at which the policies were applied for, the insured had, for some time, been suffering from heart disease, no mention thereof was made in either…
