MORRISON, Presiding Judge.

The offense is driving while intoxicated, a felony; the punishment, 90 days in jail and a fine of $100.00.

The witness Henderson testified that, while he was driving alone in the city of Houston, an automobile traveling in the opposite direction crossed the center of the street, entered his lane, and collided with his automobile. He was unable, because it was a rainy night, to testify whether a man or woman was driving, but did say that after the collision he saw only two people in the automobile, a man and a woman.
