This is the second appeal of this libel action. The District Court initially found that defendants were protected by a common law privilege for communications to the legislature and dismissed the complaint. 561 F.Supp. 1184 (D.D.C.1983). On appeal a divided panel of this court found that defendants had not demonstrated all of the elements necessary to claim the privilege and remanded the case to the District Court. 731 F.2d 1 (D.C.Cir.1984).
