This is a suit in trespass to try title brought by Harry H. Pomeroy et al., who will be designated herein as the plaintiffs, against Myron A. Pearce, who will be designated as the defendant. The trial court rendered judgment for the defendant, and plaintiffs appealed. The Court of Civil Appeals affirmed that judgment, and writ of error was granted by the Supreme Court. The case was referred to Section B of the Commission of Appeals.
