I.Introduction
This matter is before the court on the complaint of the plaintiff chapter 7 trustee, Thomas M. Bruinsma (“Trustee”), for a judgment avoiding the security interest of defendant Citizens Banking Corporation (“Bank”) pursuant to 11 U.S.C. § 544, and for related relief. The court held a hearing on August 19, 1998, at which time the parties stipulated to the material facts and introduced two joint exhibits.
