MEMORANDUM AND ORDER

SHARP, Chief Judge.

This case is presently before the court on a petition for writ of habeas corpus, filed *841pursuant to 28 U.S.C. § 2254 by an inmate at the Indiana State Prison in Michigan City, Indiana. In accord with Townsend v. Sain, 372 U.S. 293, 83 S.Ct. 745, 9 L.Ed.2d 770 (1963), the now complete state court record has been filed with and carefully examined by this court.

This case was originally filed in this court on September 21, 1981. On November 6, 1981, the respondents filed their Return to Order to Show Cause and what was purported to be the complete state court…
