This action was brought in the Circuit Court of Volusia County, Florida, by R. A. Elrod, to recover damages for injuries received by him as a result of the enforcement of an allegedly unconstitutional ordinance passed by the City of Daytona Beach. This appeal is predicated on two assignments of error which are directed at two orders of the trial judge sustaining demurrers to the plaintiff’s declaration and second amended declaration filed in this cause.
