Plaintiff, First Bank of Oak Park, as trustee (Bank), brought a forcible entry and detainer action against defendant, Thomas Carswell, d/b/a Soul D’Elegence (Carswell), for damages and possession of the premises located at 901 S. Fifth Avenue, Maywood, Illinois. On August 27, 1981, the circuit court, sitting without a jury, entered judgment in the Bank’s favor for possession and damages in the amount of $3,550, representing rent due and owing.
