Defendants, William and Howard Silverman, move pursuant to Rule 35, Fed*864eral Rules of Criminal Procedure, or in the alternative, pursuant to 28 U.S.C. § 2255, to correct, vacate, or set aside their sentences. Both defendants were found guilty of conspiring to transport stolen securities, valued in excess of $100,000, in interstate commerce in violation of 18 U.S.C. § 371.1 At oral argument, this Court dismissed Howard Silverman’s motion because it was predicated on the false assumption that he was sentenced under 18 U.S.C. § 4208(a)(2).2 The…
