In an order entered on November 21,2005 (the “2005 order”), the trial court below granted partial summary judgment in favor of the City of East Point (“East Point”) on East Point’s breach of contract claim against Fulton County (the “County”) and Arthur Ferdinand as Tax Commissioner of Fulton County (the “Commissioner”). The trial court ruled that the County and the Commissioner breached their contract to bill, collect, and remit ad valorem taxes on behalf of East Point by withholding $2,885,827.84 from East Point’s 2004 tax proceeds.
