Plaintiff the National Association for Fixed Annuities (“NAFA”) brings this action under the Administrative Procedure Act (“APA”), 5 U.S.C. § 701 et seq., and the Regulatory Flexibility Act (“RFA”), 5 U.S.C. § 604 et seq., challenging three final rules promulgated by the Department of Labor on April 8, 2016.
