The People have moved for an order pursuant to section 2785 (2) (a) of the Public Health Law directing the disclosure of certified copies of the HIV test results of the defendant, A.T., who has been charged with reckless endangerment in the first degree (Penal Law § 120.25) and attempted assault in the first degree (Penal Law §§ 110.00, 120.10 [3]).
