Appeal from a judgment of the Appellate Division of the Supreme Court in the second judicial department, entered September 25, 1914, upon an order reversing a judgment in favor of plaintiff entered upon a verdict and directing a dismissal of the complaint. This action is brought under the Federal Employers’ Liability Act of April 22, 1908 (35 Sbat. at L. 65, ch. 149; U. S. Comp. Stat. Supp. 1911, p. 1322), to recover damages for personal injuries sustained by the plaintiff while engaged as an employee of the defendant in a shop near Hoboken, FT. J.
