The plaintiff, Peter Hickey, has been a licensed race horse trainer for approximately 30 years. In 1994, post-race test results revealed that six horses for which he was responsible had been administered a bronchodilator called albuterol, the use of which violates Illinois racing law. As a result, the racing stewards suspended Hickey’s license 30 days for each violation — a total of 180 days.
