Defendant, who has no prior record, was a licensed stockbroker with Shearson Lehman. He came to his office over the weekend to catch up on paperwork and accidentally left a bag *582containing a loaded gun in the elevator. Defendant has been indicted for one count of criminal possession of a weapon in the third degree. (A previous indictment for the same charge was dismissed for reasons set forth in a written opinion dated March 13, 1995.)
