The appellants-assignors, John D. Linton and Rose Marie Linton executed and filed a voluntary assignment for the benefit of creditors of all of their non-exempt real and personal property pursuant to ch. 128, Stats., in the Circuit Court for Monroe county on May 27, 1975. On May 29, 1975, Jerome S. Schmidt was appointed receiver by order of the court and given broad authority to liquidate the assets for the benefit of the creditors.
Originally 2,283 acres of land, all located in Monroe county, were assigned to Schmidt as assignee and trustee. Of this total 112 acres were sold to one Dutton for…
