The initial action in the proceedings here involved (Atwood v. Atwood, 229 Minn. 333, 39 N. W. [2d] 103) was commenced in the District Court of Hennepin County as an action for separate mainte nance, of which that court had original jurisdiction. Defendant appeared by way of a cross bill for absolute divorce. Plaintiff’s claim that she was entitled to separate maintenance was dismissed prior to trial, and the trial was had solely on the issue of whether or not defendant was entitled to an absolute divorce.
