Appeal by residuary legatees from so much of a decree of the Surrogate’s Court, Nassau County, settling the intermediate account of the executors, as allows the claim of one Alice Jones as a valid claim against the estate of decedent Philip Rhinelander, and as adjudges that the legacy in favor of four persons in paragraph “ Fifth ” of the will is a valid testamentary disposition.
