MEMORANDUM OPINION AND ORDER

KRAM, District Judge.

Terry Hasenstab, a retired police officer with the New York City Police Department (“NYPD”), commenced this action pursuant to 42 U.S.C. § 1983. Hasenstab alleges that the NYPD violated his fourteenth amendment due process rights by failing to notify him that he passed a promotional examination for the position of sergeant, failing to promote him to that position, and selectively promoting persons who were on sick leave.
