Appellants, as partners and commission merchants in New York City, through one of their traveling salesmen, it is claimed, received an order from appellee Patterson, a retail merchant in Ft. Wayne, Indiana, for certain underwear, to be thereafter shipped to the latter. The alleged order was dated January 26, 1904. On July 15, 1904, appellants shipped the underwear to said appellee, who, on July 22, notified appellants of the receipt of invoices for said goods, but that he would not receive them, and that they were at the freight-house awaiting appellants’ order.
