George Gordon recovered a judgment against the Banner Oil & Gas' Company for the sum of $15,417.50, from which the defendant has appealed.

Plaintiff’s suit was for damages for the breach of two contracts alleged to have been made by and between him and the defendant, an unincorporated joint-stock association, acting by and through its agent, one H. A. Pagenkopf, for oil well drilling work to be done by plaintiff for the defendant, and also for $93 as the value of certain supplies used in said drilling operations and furnished by plaintiff at the instance and request of the defendant, acting…
