LOTTINGER, Judge.
This is a suit wherein the plaintiff seeks damages for injuries to his reputation and the ruin of his trade and profession. By virtue of a judgment rendered in the lower court on July 16; 1951, it 'was dismissed as of non-suit as being violative of the provisions of Code Prac. Art. 172. Counsel for plaintiff then moved for and was granted an appeal to this court returnable on or before August 28, 1951.
