Judge Pryor:

It was doubtless the intention of the legislature that the evidence of the widow’s renunciation of the provisions of her husband’s will for her benefit should be in writing, and made a matter of record in the court where the probate of the will was- had. The renunciation is required to be acknowledged either before the clerk or two subscribing witnesses and necessarily implies a written renunciation signed by the party making it.
