Prior to the 15th day of March, 1930, the plaintiff, Mary G. Collins, and the defendant C. Irene Ginty were the owners of the Hotel Kenmore in the city of Lockport, N. Y. Having sold the hotel property on that day to one Adolph Karch, since deceased, and to the defendants Otto Kessler and Lena Kessler, the latter made, executed and delivered to the plaintiff and to C. Irene Ginty two several bonds secured by mortgages upon the property. The bond to the plaintiff was conditioned for the payment of the sum of $25,850, and the, bond to C.
