Appeal from a judgment of the circuit court for Kenosha ■county: E. B. BeldeN, Circuit Judge. This is an action to recover damages for the loss of an eye which it is alleged is attributable to' the negligence of the defendant. The case was before this court on a former appeal from the judgment of the lower eourj, and'is reported in 125 Wis. 575, 104 N. W. 705. The defendant is a corporation engaged in manufacturing at Kenosha, Wisconsin.

Upon the former appeal to this court it was held that the evidence before the court required submission of the case to the jury upon the issues of defendant’s negligence and plaintiff’s assumption of the risk of the dangers incident to the operation of the alleged defective machine. 125 Wis. 575, 104 N.
