OPINION AND ORDER

GORDON, District Judge:

This matter comes before the Court on defendant’s motion for a summary-judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure.

On July 13, 1968, an automobile driven by Marion L. Stevens was traversing a railroad crossing at Hosswood Road in St. Tammany Parish, Louisiana. A passenger, Benjamin F. Stevens, was in the automobile with Marion L. Stevens.
