*441In an action, inter alia, to recover damages for breach of contract, the plaintiff appeals, as limited by its brief, from so much of a judgment of the Supreme Court, Nassau County (Cozzens, J.), dated January 27, 2003, as, after a nonjury trial, dismissed the complaint insofar as asserted against the defendants Tony Dushaj and Montenegro Restaurant Corp.
Ordered that the judgment is reversed insofar as appealed from, on the law and the facts, with costs, the plaintiff is awarded judgment as a matter of law on the issue of liability against the defendants Tony Dushaj and Montenegro Restaurant…
